DISCLAIMER: I hereby agree to all of the following: I am participating in the Yoga and/or Fitness Classes offered by Bodhi Building Ltd, dba YogaSpa (hereinafter, “ YogaSpa”) during which I will receive information and instruction about yoga and other styles of fitness, both in person and/or on a virtual online platform. I recognize that yoga and fitness classes require physical exertion, which may be strenuous and may cause or aggravate physical injury, and I am fully aware of and willingly assume the risk and hazards involved in participating in both in person and/or virtual online classes. I understand that it is my sole responsibility to consult with a physician prior to and regarding my participation in the Yoga or Fitness Classes. I represent and warrant that I am physically fit and I have no medical condition which would prevent my full participation in the Yoga and/or Fitness Classes. I also represent and warrant that I am not currently, nor have I experienced any symptoms of the Coronavirus or COVID 19, including but not limited to coughing, sneezing, shortness of breath, trouble breathing, etc., as identified by the Center for Disease Control (CDC), in the past 3 months prior to signing this waiver. I further represent and warrant that should I or a minor person for whom I am responsible in the studio, or in any of YogaSpa's off premises classes, experience any of these symptoms, knowingly become exposed to someone who exhibited these symptoms and/or test positive for the Coronavirus or COVID 19, it is my obligation and responsibility to communicate such information to the YogaSpa Team Member as quickly as soon as I am aware that any of the above described incidents occurred. Furthermore, I represent, warrant and accept that if I am and/or was infected by the Coronavirus or COVID 19, I will wait until I am fully healed from COVID 19 and must submit to YogaSpa, documented proof of such from a medical professional before, I will be allowed to participate in in person classes in the studio(s). and/or in any off premises classes whether indoors or outdoors. In consideration of being permitted to participate in the Yoga and/or Fitness Classes, whether, in studio, online or on any premises where a YogaSpa Team Member conducts such classes (indoors or outdoors), I agree to assume full responsibility for any risk, injuries, or damages, known or unknown, including but not limited to exposure to high heat and humidity (over 100 degrees), close spatial arrangement with participants in in person classes in the studio(s), microbes such as bacteria, viruses, etc., including but not limited to, SARS-CoV-2 (the virus which causes a person to be infected with Coronavirus or COVID 19), to which I might be exposed as a result of participation in the in person classes in the studio(s) and/or any off premises locations whether indoors or outdoors. In further consideration of being permitted to participate in the in person Yoga and/or Fitness Classes, in the event of YogaSpa’s reopening from the COVID-19 shutdown and at any of YogaSpa's off premises classes, whether indoors or outdoors, I agree to submit to the required precautions taken by YogaSpa's Team as laid out by NY State, Westchester County and the CDC, including, but not limited to the following : A. Wearing facial coverings except when physically working out and during the cool-down portion of the workout. B. Submitting to required temperature checks before entering the studio(s) or any off premises location for practice, whether indoors or outdoors and anyone with a 100.1 fever will not be allowed to enter. C. Showers will be closed. However, I may use the toilet as needed. D. Use provided disinfectant and sanitizers throughout the studio(s). I am required to sanitize my hands and ensure that the hands of minors for whom I am responsible, are sanitized upon entering and leaving the building. E. I will abide by the studio(s) 6-ft floor markings around the front desk and at any off premises locations. F. I will maintain 10 feet from one another, not 6 feet in the practice room. These markings will be provided and must not be moved in any way. Based on the studio(s) space, class sizes may be limited to 6 or less participants only! G. As we have before, but particularly in the event of reopening from the COVID-19 shutdown, YogaSpa will have measures in place to disinfect the practice room between classes and we will be attending to the restrooms at least once per hour. H. The studio(s) will be fully cleaned once per day. In further consideration of being permitted to participate in the Yoga and/or Fitness Classes, I knowingly, voluntarily and expressly waive, renounce and disclaim any claim I have or may have against YogaSpa, it’s instructors, officers, directors, partners, owners and employees (collectively, Bodhi Building Ltd, dba YogaSpa “Releases”) and any Host Property owners, operators, managers, contractors and employees (collectively, Host Property "Releases") for injuries or damages that I may sustain as a result of participating in the program, including but not limited to exposure to Coronavirus or COVID 19. For myself, my heirs, successors and legal representatives, I forever release, waive, discharge, and covenant not to sue YogaSpa, it’s instructors, officers, directors, partners, owners and employees and any Host Property, its owners, operators, managers, contractors and employees, for any injury or death caused by their negligence or other acts that are not intended to harm me. I will not hold responsible or sue YogaSpa or any Host Property for any injuries suffered by me caused in whole or in any part by my failure or refusal to follow the instructions of YogaSpa or it’s instructors or Host Property owners, operators, managers, contractors or employees, including instructions for handwashing and/or sanitizing, required social (spatial) distancing, use of face covering, temperature checks and all other requirements provided herein, or by any physical impairment of mine. The tuition paid herewith and such registration fees paid hereafter are intended for participation in in person (whether on or off premises, indoor or outdoor) and/or virtual online classes, are non-refundable as a matter of right, and such refunds if any, if made shall be entirely within the sole discretion of YogaSpa . I have read the above release and waiver of liability and fully understand its contents. I voluntarily agree to the terms and conditions stated above and acknowledge that YogaSpa will not permit me to participate in any of its programs if I choose not to agree to the above stated terms and sign this waiver. My acknowledgement, understanding and agreement to all the terms in this waiver is represented by my signature of this waiver.
